But forgetting all the glorious breasts that shall be liberated, it’s always nice to see a higher court come down with a ruling strengthening fair use. Though this is a little concerning:

The appeals court instructed the district judge to evaluate whether Google knew that unauthorized copies of Perfect 10’s photos were being made available and failed to take steps to prevent it.

We certainly can’t expect justices to fully comprehend this stuff (first we have to teach them what “web sites” are), but it shouldn’t take much to realize this is a damn near impossible task. What kind of steps could really be taken? And moreover, shouldn’t this be between Perfect 10 and the parties making unauthorized copies?

Ah well, one small step for fair use, one giant leap for tiny, pixelated boobies indeed!
